1. Scope of Application
1.1 These Terms and Conditions (T&Cs) apply to all contracts between WisePetHome (hereinafter “Seller”) and the customer (hereinafter “Customer”) for the purchase of goods through our online store.
1.2 A customer is a natural person who places an order for personal use, outside of their commercial or professional activity.
2. Conclusion of Contract
2.1 The presentation of products in the online store is not a binding offer but a non-binding invitation to submit an offer.
2.2 By placing an order, the Customer submits a binding offer to conclude a contract. The Seller may accept the offer within 5 business days by sending an order confirmation via email or by shipping the goods.
2.3 The contract is concluded when the Seller accepts the Customer’s offer by confirming the order or shipping the goods.
3. Right of Withdrawal & Returns
3.1 Return Process: We take pride in offering the highest quality products, and we hope you will be fully satisfied with your purchase. In the rare event that you receive a defective or incorrect product, please contact us within 14 days of receipt. We will assist you in resolving the issue.
3.2 Return Shipping Costs: Return shipping costs are the responsibility of the Customer unless the goods were defective or incorrectly delivered by the Seller.
3.3 Non-returnable Items: Custom/personalized items, sale/clearance items, and products that have been used, damaged, or opened are non-returnable.
3.4 Cooling-off Period (EU Customers): As per EU law, customers have the right to cancel the order within 14 days after receiving the goods. The product must be unused, in its original condition, and in its original packaging for a return to be accepted.
4. Prices and Payment Terms
4.1 All prices in the online store include 19% German VAT, unless otherwise indicated. Shipping costs will be added at checkout.
4.2 Payments can be made via PayPal, credit card, bank transfer, or other secure methods provided at checkout.
4.3 Payment is due immediately upon completing the order, unless otherwise agreed.
5. Delivery and Shipping Conditions
5.1 Delivery Times: We strive to ship your order as quickly as possible. Within Europe, estimated shipping times are between 2-12 business days depending on your location, external factors, and weather conditions that may cause delays. We will keep you informed if there are any significant changes to the expected delivery time.
5.2 Shipping Costs: Shipping costs are calculated based on your location and the size of your order, and they will be displayed during the checkout process.
5.3 Weather Conditions and Shipping Delays: While we do everything in our power to ensure timely delivery, please be aware that weather conditions, especially during extreme seasons, can affect transportation and delivery schedules. If any unforeseen delays occur, we will promptly notify you.
5.4 Customer Responsibility: Delivery issues caused by incorrect addresses or refusal to accept the package will result in additional charges that are the responsibility of the Customer.
5.5 Delivery Delays: We are not responsible for delays or damages caused by the courier company during shipping, especially in the case of weather-related disruptions. Please inspect your package upon delivery and report any issues immediately.
6. Warranty and Liability
6.1 The Seller ensures that products meet legal requirements and are free from defects upon arrival. If a product is defective or damaged during transport, we will offer a solution in line with our commitment to quality and service.
6.2 Limitation of Liability: We are not responsible for damages arising from improper use, misuse, or customer mishandling of products. In no event will our liability exceed the purchase price of the defective product.
6.3 Damage During Transport: We are not responsible for damages that occur during the shipping process, which are typically caused by the courier company. We recommend checking the condition of the package upon delivery. If there’s damage, please report it to us immediately.
7. Retention of Title
The delivered goods remain the property of WisePetHome until full payment has been received.
8. Applicable Law
8.1 All contracts and claims arising under these T&Cs are governed by the laws of the Federal Republic of Germany.
8.2 This choice of law applies to the extent that it does not deprive the Customer of the protection provided by mandatory provisions of the law in their country of habitual residence.
9. Alternative Dispute Resolution
9.1 The European Commission provides an online platform for dispute resolution, which can be accessed at https://ec.europa.eu/consumers/odr.
9.2 The Seller is neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
